Terms of Service

Based on terms of service from Nadia Axel’s site

Prices are subject to change based on demand. Pricing changes do not apply to commissions that have already been accepted.
I reserve the right to decline any order for any reason.
I am willing to consider departures from these terms, but they must be discussed beforehand.

All transactions are to be conducted in USD through PayPal.
Payment will be requested through a PayPal invoice from “Malvear Art”. Work will proceed on the commissioned piece after the invoice is paid.

The time between payment and delivery will vary depending on personal circumstances as well as the difficulty and complexity of the work.
Once the piece is finished, you will receive the following:
- A full-resolution image of the artwork with my signature.
- A scaled-down web-friendly version of the image with my signature.
Before or after the above images are delivered, you may also request any or all of the following:
- A full-resolution image without my signature.
- A scaled-down image without my signature.
- Individual layers of the project exported as .PNG images with transparency, provided the desired layers are available.
- The raw project file, likely a Krita (.kra) file.

If you wish to change a feature after a commissioned piece has been delivered, the change will come with an additional charge. The amount charged will vary based on the extent of the change.
If you wish to change the project’s specifications while work is underway, the change may come with an additional charge. The amount charged will vary based on the extent of the change and the progress of the project. If you’re going to request a change, do so as soon as possible.
If an error on my part results in a feature that is inconsistent with the project’s most recent specifications, as agreed upon by artist and customer, that feature will be corrected free of charge.
I will make a good faith effort to recognize whether a piece is below my standards and make adjustments accordingly.

I, the artist:

Claim no ownership of any intellectual property related to the content of the artwork.
Have the right to distribute the commissioned piece as well as any material related to its creation. All due credit shall be given to the client, unless they decide to remain anonymous.

You, the customer:

May freely modify and distribute the commissioned piece, with or without attribution.
Retain the rights to any intellectual property related to the subject of the artwork, provided those rights were yours to begin with.
Are asked not to distribute modified versions of the commissioned piece under the pretense that the modified features are the product of my work.

If you request the cancellation of a commissioned piece before work has begun, you will receive a full refund.
If for any reason I am unable or unwilling to complete a commissioned piece, you will receive a full refund.
If you request the cancellation of a commissioned piece after work has begun, you will receive a partial refund or no refund, depending on the progress of the piece.
